Terms & Conditions

These Terms & Conditions are an agreement between you and HealthOasis ("HealthOasis", "we", "us"), the operator of healthoasis.org and the HealthOasis AI Care Navigator (the "Service").

By accessing or continuing to use the Service, you agree to these terms. If you do not agree, please stop using the Service. You confirm you are of legal age and, if you use the Service on behalf of an organisation, that you have authority to bind it.

HealthOasis provides free information and an AI assistant that helps older adults and family caregivers understand IHSS (In-Home Supportive Services) and other senior care programs. It is an information and navigation tool only.

The Service does not provide medical, legal, financial, or professional advice, and it is not a substitute for a qualified professional or an official eligibility determination. AI-generated answers may be incomplete or inaccurate — always verify important details with the relevant county, agency, or professional before acting. In an emergency, call 911. For mental health crises, call or text 988.

You must provide accurate information and keep it up to date. You are responsible for keeping your credentials confidential and for activity under your account. Tell us promptly if you suspect unauthorised use.

You must not:

• use the Service unlawfully or for fraud, spam, or harassment;
• infringe anyone's intellectual property or privacy rights;
• interfere with the security or integrity of the Service — no malware, probing, scanning, scraping, or circumventing technical or usage limits;
• attempt to jailbreak or misuse the AI assistant, or use it to generate illegal, harmful, deceptive, or abusive content;
• resell, redistribute, or reverse engineer the Service;
• submit content you do not have the right to submit.

You are responsible for what you send to the AI assistant, how you use its outputs, and for verifying their accuracy. We may remove content, filter or refuse outputs, and suspend accounts to enforce these rules.

HealthOasis retains all rights in the Service, including its software, guides, content, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your plan. You keep ownership of the content you submit and grant us a limited licence to host and process it solely to provide the Service. If you believe content on the Service infringes your rights, email us and we will review and, where appropriate, remove it; repeat infringers lose access.

HealthOasis is free to use with a monthly message allowance. Paid memberships (Sustaining Supporter and Caregiver Circle) are monthly subscriptions that renew automatically until cancelled, at the prices shown on our memberships page. Applicable taxes are added at checkout. You may cancel at any time; access continues until the end of the paid period. See our Refund Policy.

Payment, billing, tax, cancellation, and refund mechanics are also governed by Stripe's Consumer Terms of Service.

Our checkout is processed by Stripe, Inc. Stripe handles payment processing, billing, invoicing, receipts, and sales tax calculation and collection on our behalf. HealthOasis does not receive or store your card details. For questions about a charge, refund, or cancellation, contact us at help@healthoasis.org.

We work to keep the Service running, but we do not guarantee uninterrupted or error-free performance. Features may change, and we may modify or discontinue parts of the Service.

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service or close your account at any time. On termination, your right to use the Service ends; you may request a copy of your data before deletion.

To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Our aggregate liability is limited to the fees you paid in the 12 months before the claim. Nothing limits liability for fraud, death, or personal injury caused by negligence, or anything else that cannot be limited by law.

You agree to indemnify HealthOasis against claims arising from your content, your unlawful use of the Service, or your breach of these terms.

These terms are governed by the laws of the State of California, and the courts of California have exclusive jurisdiction, unless mandatory local law says otherwise. You may not assign these terms without our consent; we may assign them in connection with a merger or transfer of the organisation. Neither party is liable for delays caused by events beyond reasonable control. If a provision is unenforceable, the rest remains in effect. We may update these terms and will post the new date above.
